The proposed development is located within the countryside where new residential development is strictly controlled by Policies S2 and CO1 of the Sedgemoor Local Plan. Whilst Policy CO2 allows for limited infill development within settlements, the proposal fails to constitute a genuine infill opportunity. The site is not positioned between existing built form and does not represent the development of a small gap within the main built-up area of the settlement. Instead, it would extend residential development into land where there is no clear or consistent pattern of built form and which does not form part of the established built-up area. As such, the proposal would fail to maintain a sustainable pattern of development and would be contrary to Policies S2, CO1 and CO2 of the Sedgemoor Local Plan 2011-2032.

The proposed development is located within the catchment of the Somerset Levels and Moors Ramsar site and within the Bat Consultation Zone associated with the North Somerset and Mendip Bats Special Area of Conservation. In the absence of sufficient supporting assessment and mitigation, it has not been possible to rule out likely significant effects on these European sites, either alone or in combination with other plans or projects. The proposal therefore constitutes 'habitats development' for the purposes of Article 5B of the Town and Country Planning (Permission in Principle) Order 2017 (as amended). As such, permission in principle must not be granted. The proposed development is therefore contrary to Article 5B of the Town and Country Planning (Permission in Principle) Order 2017 (as amended), policy D20 of the Sedgemoor Local Plan 2011-2032 and the Conservation of Habitats and Species Regulations 2017.
