The application has failed to demonstrate that the caravan is situated outside the land subject to the extant Enforcement Notice issued in July 2010. Evidence indicates that part of the caravan falls within the area affected by the notice and, as such, the notice applies to the development. The residential use of the caravan is therefore unlawful and cannot be certified as lawful.

The evidence submitted is insufficient to demonstrate, on the balance of probabilities, that the caravan has been in continuous residential use for a period of at least ten years, as required by Section 171B(3) of the Town and Country Planning Act 1990. The statutory declarations are not adequately corroborated by supporting documentary evidence, and gaps remain in the occupation history of the caravan. Accordingly, the lawful use claimed has not been proven.
