Operational development is 'the carrying out of building, engineering, mining or other operations in, on, over or under land' It involves engineering operations as it includes: • Excavation of the ground • Formation of a pit or chamber • Installation of a fixed tank and pipework • Backfilling and permanent alteration of land The certificate of lawfulness is therefore refused.
