The proposal fails to provide accurate baseline ecological information and a compliant Biodiversity Net Gain (BNG) assessment, misclassifying Coastal Floodplain Grazing Marsh (a Section 41 priority habitat) as modified grassland, and fails to submit the necessary Habitats Regulations Assessment (HRA/shadow HRA) and outstanding protected species surveys (bats in trees; water voles). As such, the application conflicts with the Conservation of Habitats and Species Regulations 2017, the NPPF (Natural Environment; Habitats Regulations compliance; mitigation hierarchy; biodiversity net gain), and Local Plan Policy D20.

The development does not comply with Axe Brue Internal Drainage Board standing advice requiring a 9-metre buffer from rhyne banks. The proposed 3-metre buffer fails to demonstrate maintenance access protection or obtain consent, contrary to the NPPF (Flood risk and water environment) and Local Plan Policy D1.
