The evidence provided is insufficient for the Authority to be satisfied, on the balance of probability, that the dwelling known as 'Little Lovedere' was constructed without the benefit of planning permission for the period in excess of 10 years up until the date of the receipt of the application for a certificate of lawfulness. This is due to the dwelling being subject to a reserved matters approval ref 27/81/002 and this was granted on 20 May 1981. The plans and elevations approved at the time were consistent with the dwelling that was constructed on site and therefore the initial build appears to be in line with the permission(s). The conditions of the original outline consent 27/78/001 would apply to the occupation of the dwelling.
