In the absence of adequate ecological information, the Local Planning Authority is unable to conclude that the proposed development would not result in harm to bats or their roosts, or that the proposal could be undertaken lawfully in accordance with the Conservation of Habitats and Species Regulations 2017 (as amended) and the Wildlife and Countryside Act 1981 (as amended). The proposal therefore fails to satisfy the requirements of paragraph W (3) of Part 3 Schedule 2 of the General Permitted Development Order 2015 (As amended) (England).
