Approval of the details of the appearance, landscaping, layout and scale (hereinafter called "the reserved matters") of the Primary school, neighbourhood centre and upto 437 dwellings shall be submitted in phases and obtained from the local planning authority in writing before any development in the relevant phase is commenced. Plans and particulars of the reserved matters referred to above, relating to the appearance, landscaping, layout and scale, shall be submitted in writing to the local planning authority and shall be carried out as approved. Applications for approval of the reserved matters shall be made to the local planning authority before 08/08/2026 or by 08/08/2028 for the school and neighbourhood centre. The development hereby permitted shall be begun before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later. Reasons: The application was submitted as an outline application in accordance with the provisions of Article 5(1) of the Town and Country Planning (Development Management Procedure) Order 2015. In accordance with the provisions of Section 92 of the Town and Country Planning Act, 1990 (As amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

The 238 dwellings to the south of the site and two means of access onto A39 hereby permitted shall be carried out in accordance with the detailed approved plans listed in schedule A. The outline application for the Primary School Site, neighbourhood centre and up to 437 dwellings shall be carried out in accordance with the parameter plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.

Before any work is commenced a programme showing the phasing of the development shall be approved in writing by the local planning authority and the development shall not proceed other than in accordance with the approved programme. Reason: This condition is pre commencement in the public interest to secure a satisfactorily correlated order of development.

The development hereby approved shall be carried out in accordance with the previously submitted and approved (ref 51/19/00003) "Local Labour Statement" and Prior to the commencement of development of each subsequent phase, a written commitment to the sourcing of local labour shall be submitted to and approved in writing by the local planning authority. The written commitment, as a minimum, shall set out the following matters: i) The proportion of construction workers to be sourced from the local labour pool, ii) Work experience/ apprenticeship opportunities; iii) The proportion of local procurement and sourcing; iv) On-going skills development and training opportunities; v) The steps that will be taken to ensure that the above is implemented; vi) The operator shall maintain a record of i - v above and shall make that information available to the local planning authority at all reasonable times upon request. Reason: In accordance with policy D15 of the Local Plan. This matter needs to be agreed prior to commencement in order to ensure that local labour is used in the project from the start.

The development hereby approved shall be carried out in accordance with the previously submitted and approved (ref 51/19/00003) "Arboricultural Survey, Impact Assessment and Protection Plan Rev D" (Barton Hyett 2019) and "Tree Survey Report" (Barton Hyett 2019) and prior to the commencement of each subsequent phase of development an arboricultural method statement and tree protection plan shall be prepared and submitted to the local planning authority for approval. The trees and hedgerows identified for retention on the Tree Retention and Removal Plan shall be protected in accordance with the details as submitted on the Tree Protection Plan and all construction works shall be carried out in accordance with the approved method statement. Reason: This condition is pre commencement to ensure that the approved development can be undertaken with minimal risk of adverse impact on the retained trees and hedgerows and in the interests of the visual amenities of the site in accordance with Policies D2 and D19 of the Local Plan.

The development hereby approved shall be carried out in accordance with the previously submitted and approved (ref 51/19/00003) "MCEL Draft Managmeent Organisation Chart", "Infrastructure Advance TM Signing", "Cokerhurst Farm Infrastructure" (Montel Nov 2023), "Construction Access Layout Secton Drg No. SK018, Rev. C", "Proposed Traffic Management Phasing Plan" (Montel 2023) and "Proposed Compound Layout" (Montel 2023) and prior to the commencement of each subsequent phase of development including any site clearance, groundworks or construction within each sub-phase (save such preliminary or minor works that the Local Planning Authority may agree in writing), a Construction Traffic and Environment Management Plan (CTEMP) to manage the impacts of construction during the life of the works, shall be submitted to and approved in writing by the Local Planning Authority. For the avoidance of doubt, the CEMP shall, amongst other things, include: a) Construction Traffic Management Plan. b) Measures to regulate the routing of construction traffic; c) The importation of spoil and soil on site; d) The removal /disposal of materials from site, including soil and vegetation; e) The location and covering of stockpiles; f) Details of measures to prevent mud from vehicles leaving the site and must include wheel- washing facilities; g) Control of fugitive dust from earthworks and construction activities; dust suppression measures; h) Noise and Vibration control plan (which includes control methods) to include mitigation measures as defined in BS 5528: Parts 1 and 2: 2009 'Code of practice for noise and vibration control on construction and open sites' shall be used to minimise noise or vibration disturbance from construction works; i) A waste disposal policy (to include no burning on site); j) Measures for controlling the use of site lighting whether required for safe working or for security purposes; k) Details of any site construction office, compound and ancillary facility buildings; l) Specified on-site parking for vehicles associated with the construction works and the provision made for access thereto; m) A point of contact (such as a Construction Liaison Officer/site manager) and details of how complaints will be addressed, including an appropriate phone number. n) construction operation hours, o) construction delivery hours, p) expected number of construction vehicles per day, q) car parking for contractors, r) specific measures to be adopted to mitigate construction impacts in pursuance of the Environmental Code of Construction Practice and a scheme to encourage the use of public transport amongst contractors The details so approved and any subsequent amendments as shall be agreed in writing by the Local Planning Authority shall be complied with in full and monitored by the applicants to ensure continuing compliance during the construction of the development. Reason: This condition is pre commencement in the interests of highway safety and to protect the amenity of local residents from potential impacts whilst site clearance, groundworks and construction is underway in accordance with Policies D13, D14 and D25 of the Local Plan.

The site of the proposed development may be contaminated. The development hereby approved shall be carried out with the submitted and previously approved (ref 51/19/00003) "Earthworks Specification" (GeoConsulting Engineering Ltd Oct 2023), "Technical Note: Geo-Environmental" (MEC March 2021), "Supplementary Ground Investigation Report" (MEC May 2019), "Ground Investigation Report" (MEC March 2019) and "Geo Environmental Desk Study" (MEC 2019). Unless otherwise agreed by the Local Planning Authority, development other than that required to be carried out as part of an approved scheme of remediation on each phase must not commence until condition C has been complied with for the relevant phase. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until condition D has been complied with in relation to that contamination. A. Site Characterisation A detailed site investigation and risk assessment must be completed in accordance with current UK guidance to assess the nature, extent and scale of any contamination on the site, whether or not it originates on the site. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The investigations, risk assessments and written reports must be approved in writing by the Local Planning Authority. The report of the findings must include: (i) a survey of the extent, scale and nature of contamination; (ii) desk study information, conceptual models, investigation methods, investigation results and interpretation and any other information required by the local planning authority to justify and appraise the report findings. (iii) an assessment of the potential risks to: o human health, o property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, o adjoining land, o groundwaters and surface waters, o ecological systems, o archaeological sites and ancient monuments; (iv) an appraisal of remedial options, and proposal of the preferred option(s). This must be conducted in accordance with current UK guidance including DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'. B. Submission of Remediation Scheme In cases where contamination is shown to exist a detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property, the natural and historical environment and surrounding land must be prepared, and approved in writing by the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation. C. Implementation of Approved Remediation Scheme The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report (referred to in PPS23 as a validation report) that demonstrates the effectiveness of the remediation carried out must be produced, and approved in writing by the local planning authority. D. Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirements of condition A, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of condition B, which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with condition C. E. Long Term Monitoring and Maintenance If a monitoring and maintenance scheme, to include monitoring the long-term effectiveness of the proposed remediation, is required as part of the approved remediation scheme then the monitoring and maintenance scheme will need to be approved in writing by the local planning authority. Following completion of the measures identified in that monitoring and maintenance scheme and when the remediation objectives have been achieved, reports that demonstrate the effectiveness of the monitoring and maintenance carried out must be produced, and submitted to the Local Planning Authority for approval. This must be conducted in accordance with current UK guidance including DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'. Reason: This condition is pre commencement to ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.

The development hereby permitted shall be carried out in accordance with the previously submitted and approved (ref 51/19/00003) "Written Scheme of Investigation for an Archaeological Excavation - Sep 2023" (Cotswold Archaeology). Reason: To ensure that the heritage asset surrounding the site is appropriately recorded in accordance with Policy D26 of the Local Plan

The development hereby approved shall be carried out in accordance with the previously submitted and approved (ref 51/19/00003) "Horizontal Illuminance Lighting Calculation Drg No. OP000177928-LD15670_01A" and prior to commencement of development of each subsequent phase, a "lighting design strategy" for the relevant phase shall be submitted to and approved in writing by the local planning authority. The lighting design strategy shall: a) identify areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance in or around their resting places or along important routes used to access key areas of their territory, for example, for foraging; and b) show how and where external lighting will be installed (through the provision of lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent the above species using their territory or having access to their resting places. c) consider the visual impact of lighting when viewed from the AONB All external lighting shall be installed in accordance with the specifications and locations set out in the design strategy, and these shall be maintained thereafter in accordance with the design strategy. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: A pre-commencement condition in the interests of the 'Favourable Conservation Status' of populations of European protected species and the wider visual impact of development in accordance with Policies D19, D20 and D21 of the Sedgemoor Local Plan

The development hereby approved shall be carried out in accordance with the previously submitted and approved "Framework Construction Ecological Management Plan" (CSA Environmental Dec 2018) and prior to the commencement of development for each subsequent phase (including ground works, vegetation clearance) a construction environmental management plan (CEMP: Biodiversity) shall be submitted to and approved in writing by the local planning authority. The CEMP (Biodiversity) shall include the following: a) Risk assessment of potentially damaging construction activities. b) Identification of "biodiversity protection zones". c) Practical measures (both physical measures and sensitive working practices) to avoid or reduce impacts during construction (may be provided as a set of method statements). d) The location and timing of sensitive works to avoid harm to biodiversity features. e) The times during construction when specialist ecologists need to be present on site to oversee works. f) Responsible persons and lines of communication. g) The role and responsibilities on site of an ecological clerk of works (ECoW) or similarly competent person. h) Use of protective fences, exclusion barriers and warning signs. The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority. Reason: A pre-commencement condition in the interests of European and UK protected and priority species and in accordance with Policy D20 of the Sedgemoor Local Plan

Prior to the commencement of ground works for each phase of development a landscape planting scheme shall be prepared in accordance with the submitted landscape strategy plan and submitted to the Local Planning Authority for approval. The approved planting scheme shall be implemented in the first planting season following the completion of each phase of the development or otherwise agreed. Notwithstanding the submitted details and for the avoidance of doubt the landscape scheme shall comprise a landscape masterplan which identifies the trees to be retained, removed and proposed. The proposed planting scheme shall include a detailed scaled drawing which identifies the proposed green infrastructure and includes a plant schedule and planting specification. The planting schedule shall detail the proposed species, quantities, stock sizes, planting densities and spacings. Reason: To ensure that development sites are appropriately landscaped to provide enhancement of the environment, mitigation for vegetation that is to be removed, to ensure biodiversity is maintained and that planting schemes are established and managed into the future. This is in accordance with Policies D19 and D20 of the Local Plan

Prior to the commencement of ground works on each phase of development an Arboricultural Clerk of works (ACW) shall be appointed by the "client", applicant or their agent. The ACW shall be competent in arboriculture and have experience of trees on construction sites. The ACW shall monitor the erection of temporary protective fencing and ground protection measures and the removal of trees and vegetation clearance in accordance with the submitted arboricultural method statement. Reason: To ensure that construction works do not have a detrimental impact on the existing trees/hedgerows that are to be retained in accordance with policies D19 and D30 of the Local Plan.

The submission of reserved matters with the exception of the School and the Neighbourhood Centre shall be accompanied by details of the surface water drainage scheme for the northern watercourse based on sustainable drainage principles together with a programme of implementation and maintenance for the lifetime of the development. The drainage scheme shall detail the measures taken to explore the creation of a wetland area incorporating multi-functional flood risk management features along the northern watercourse. The drainage scheme shall seek to combine the existing northern watercourse and proposed surface water attenuation areas and : Comply with the requirements of national planning policy in that flood risk should not be increased to third parties Provide betterment in flows within the watercourse system of at least 15% which is equal to that shown in the approved Flood Risk Assessment Not require any additional land beyond that shown for the off line northern watercourse attenuation scheme outlined drawing 21346_01_230_01 Rev J in Appendix M of the approved Flood Risk Assessment Be cost effective against the current proposals within the approved outlined drawing 21346_01_230_01 Rev J Demonstrate discharge rates from the site are comparable to the QBAR rate of 33.4 l/s (north and central catchment) stated in Table 6 of the approved Flood Risk Assessment Should the exploration conclude that a wetland area incorporating multifunctional flood risk management features along the northern watercourse is not feasible, the 'off line' SuDS areas as currently set out within the approved Flood Risk Assessment ref 21346/01-19/5616 Rev D shall be implemented, unless otherwise agreed in writing. Reason: In the interests of flood risk and biodiversity in accordance with Policies D1 and D20 of the Local Plan and guidance contained within the NPPF.

No development shall commence on construction of the buildings on any phase until surface water drainage works for that phase have been implemented in accordance with details that have been submitted to and approved in writing by the local planning authority. Such scheme should aim to meet the four pillars of SuDS (water quantity, quality, biodiversity, and amenity) to meet wider sustainability aims as specified by The National Planning Policy Framework (July 2018) and the Flood and Water Management Act (2010). The development shall include measures to prevent the control and attenuate surface water and once approved the scheme shall be implemented in accordance with the approved details and maintained at all times thereafter unless agreed otherwise in writing by the local planning authority. The system should be designed such that there is no surcharging for a 1 in 30 year event and no internal property flooding for a 1 in 100 year event + 40% allowance for climate change. The submitted details shall: i. provide information about the design storm period and intensity, the method employed to delay and control the surface water discharge rate and volume from the site and the measures taken to prevent pollution of the receiving groundwater and/or surface waters; and ii. provide a plan indicating flood exceedance routes, both on and off site in the event of a blockage or rainfall event that exceeds the designed capacity of the system; iii. detail the boundary of the open spaces and SUD features within that phase, including maintenance strips and access tracks and; iiii. provide a management and maintenance plan for the lifetime of the development which shall include the arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime. Including: details of land ownership; maintenance responsibilities; a description of system; the identification of individual assets, services and access requirements; details of routine and periodic maintenance activities. The surface water drainage scheme shall be implemented in accordance with the agreed details for each phase and shall be managed and maintained thereafter in accordance with the agreed management and maintenance plan for the lifetime of the development. Reason: This condition is pre commencement in the interests of the securing appropriate drainage for the development site and ensure no increased flood risk in accordance with Policy D1 of the Local Plan and advice contained in the NPPF.

Each phase of development will provide details of the roofing materials and of the materials to be used in the construction of the external walls of the buildings prior to construction of the buildings commencing on site for that phase. These shall be approved in writing by the local planning authority and implemented in accordance with the agreed details. Reason: In the interests of visual amenity and in accordance with Policy D2 of the Local Plan.

Prior to the commencement of construction on each phase details of the hard landscaping shall be submitted to and approved in writing for that phase with the Local Planning Authority. The development of each phase shall then be carried out in accordance with the approved details. Reason: In the interests of the visual amenity of the surrounding area and highway safety in accordance with Policies D2, D13 and D14 of the Local Plan.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re- enacting that Order with or without modification ), no fences, gates or walls shall be erected within the curtilage of any dwellinghouse forward of any wall of that dwellinghouse which fronts onto a road. Reason: In the interests of the visual amenities of the area and in accordance with Policy D1 of the Local Plan.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re- enacting that Order) (with or without modification), no extensions, alterations or additional windows/dormer windows other than those expressly authorised by this permission shall be constructed on plots 144-148. Reason: In the interests of the amenities of the adjoining occupiers and in accordance with Policies D2 and D25 of the Local Plan.

All public landscape areas shall be protected and maintained, and any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species unless the LPA has given its written consent to any variation. Reason: To ensure that development sites are appropriately landscaped to provide enhancement of the environment, mitigation for vegetation that is to be removed, to ensure biodiversity is maintained and that planting schemes are established and managed into the future. In the interests of visual amenity. This is in accordance with Section 12 of the NPPF and Policies D2 and D20 of the Sedgemoor District Local Plan.

All tree surgery shall be carried out in accordance with BS 3998 : 2010 (Tree work -Recommendations) by a suitably qualified arboriculturalist.Tree surgery and vegetation removal shall not be carried out during the bird season which is approximately between March and September(inclusive). If this is not possible, a survey for nesting birds shall be carried out immediately prior to commencement of the works by a suitably qualified ecologist, submitted to and approved in writing by the LPA. Any nesting birds discovered will be buffered by an exclusion zone determined by the ecologist which will remain in force until any chicks have fledged. Reason: In the interests of good arboricultural practice and to ensure compliance of the Wildlife & Countryside Act 1981: Part1and in accordance with Policy D20 of the Local Plan.

No development hereby approved which shall interfere with or compromise the use of footpath BW 34/19 shall take place until a path diversion order has been made and confirmed, the diverted route shall be made available to the satisfaction of the Local Planning Authority in accordance with the agreed details. Reason: In the interests of the accessibility of the site and to comply with Policy D13 of the Local Plan.

No demolition/construction work (other than completely internal fitting out) or deliveries to and from the site shall take place outside the hours of 07:00 to 18:00 Mondays to Fridays, 08:00 to 13:00 on Saturdays, with the exception of specific works which shall have been agreed in advance and in writing by the local planning authority and shall include details of the task, the date and duration of works. No works to take place on Sunday and Bank Holidays. Reason: To protect the amenity of local residents from potential impacts whilst site clearance, groundworks when construction is underwayin accordance with Policies D2 and D25 of the Local Plan.

In the interests of sustainable development none of the dwellings hereby permitted shall be occupied until a scheme detailing how a network of cycleway and footpath connections will be phased and constucted within the development is been submitted to and agreed in writing with the Local Planning Authority. The agreed links shall then be constructed within the development site in accordance with the agreed details and completed on each phase prior to the final occupations within that phase and maintained as open and accessible routes thereafter. Reason: In the interests of Highway safety and to comply with Policies D13 and D14 of the Local Plan.

Prior to occupation of the development an appropriate right of discharge for surface water shall be obtained before being submitted to and approved in writing by the Local Planning Authority. A drainage scheme for the site showing details of gullies, connections, soakaways and means of attenuation on site shall be submitted to and approved in writing by the Local Planning Authority. The drainage works shall be carried out in accordance with the approved details and maintained as such thereafter. Reason: In the interests of Highway safety and to comply with Policies D13 and D14 of the Local Plan.

The areas allocated for parking and turning shall be kept clear of obstruction and shall not be used other than for parking and turning of vehicles in connection with the development hereby permitted. The proposed western and eastern access shall be constructed generally in accordance with details shown on the submitted plan, drawing number S278 Design Parameters 3-Arm Junction Drg No. 101, and shall be available for use before first occupation of any dwellings served off that access. Once constructed the access shall be maintained in accordance with the agreed details. Reason: In the interests of Highway safety and to comply with Policies D13 and D14 of the Local Plan.

A Condition Survey of the existing public highway will need to be carried out and agreed with the Highway Authority prior to any works commencing on site, and any damage to the highway occurring as a result of this development is to be remedied by the developer to the satisfaction of the Highway Authority once all works have been completed on site. Reason: In the interests of Highway safety and to comply with Policies D13 and D14 of the Local Plan.

The development hereby permitted shall not be first occupied until the developer has applied for a Traffic Regulation Order (TRO) to prevent parking on the A39 along the site boundary. The TRO shall then be advertised and, if successful implemented at the developer's expense to the satisfaction of the Local Planning Authority prior to first use of the school. Reason: In the interests of Highway safety and to comply with Policies D13 and D14 of the Local Plan.

No development approved by this permission shall be occupied or brought into use until a plan for the future responsibility and maintenance of the surface water drainage system has been submitted to and approved by the Local Planning Authority. The approved drainage works shall be completed and maintained in accordance with the details agreed. Reason: To safeguard the long-term maintenance and operation of the proposed system to ensure development is properly drained in accordance with the NPPF.
