By virtue of the siting, size, scale and design of the dwelling, the development is not considered to sufficiently reflect the constraints of the infill plot and offer a high-quality design that positively responds to the existing character of the area. As such the development if permitted would give rise to an unacceptable harm on the traditional character of the area and the street scene. Accordingly, the proposed development is contrary to policy D2 Sedgemoor Local Plan 2011-2032.

By virtue of the siting, size, massing and window arrangement proposed of the dwelling together with the loss in its entirety of the landscaping which offered a degree of screening, the development proposed will give rise to an unacceptable degree of overlooking and loss of privacy. The sense of which is likely to be further emphasised by virtue of the scale and design of the dwelling. As such the proposed development is contrary to policy D25 Sedgemoor Local Plan 2011-2032.

The application fails to offer any meaningful replacement planting for the loss of the mature landscaping that has occurred since the granting of the outline permission. The approach has resulted in harm to the character of the area, the visual appearance of the site together with loss of natural screening and biodiversity impacts. Furthermore, whilst a condition attached to the outline requires 2 fruit trees to be planted the detail proposed fails to provide for this, a necessary biodiversity enhancement even prior to the removal of the mature landscaping. There is very limited scope given the scale of the dwelling to allow for any meaningful landscaping and it is not considered that the proposal as submitted gives rise to an adequately landscaped site, or indeed scope for such to be secured by condition. As such the development as proposed is found contrary to policy D2, D19 and D20 Sedgemoor Local Plan 2011-2032.
