Approval of the details of the access, appearance, landscaping, layout and scale (hereinafter called "the reserved matters") for the proposed school shall be obtained from the local planning authority in writing before any development is commenced on this element (other than laying out as defined within the informatives). Plans and particulars of the reserved matters referred to above, relating to the access, appearance, landscaping, layout and scale, shall be submitted in writing to the local planning authority and shall be carried out as approved. Application for approval of the reserved matters shall be made to the local planning authority before the expiration of three years from the date of this permission. The development hereby permitted shall be begun before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later. Reasons: The application was submitted as an outline application in accordance with the provisions of Article 5(1) of the Town and Country Planning (Development Management Procedure) Order 2015. In accordance with the provisions of Section 92 of the Town and Country Planning Act, 1990 (As amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.

The development of the site shall be carried out in accordance with the CMP details that were submitted on 08.02.2022 and approved as DOC on 52/19/00001 and any subsequent amendments as shall be agreed in writing by the Local Planning Authority shall be complied with in full and monitored by the applicants to ensure continuing compliance during the construction of the development. Reason: This condition is pre commencement to protect the amenity of local residents from potential impacts and in the interests of highway safety whilst site clearance, groundworks and construction is underway in accordance with Policies D24, D25, D13 and D14 of the Local Plan.

The development shall be carried out in accordance with details that were submitted on 07.02.2022 and approved as DOC on 52/19/00001 D. Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirements of condition A, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of condition B, which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with condition C. E. Long Term Monitoring and Maintenance If a monitoring and maintenance scheme, to include monitoring the long-term effectiveness of the proposed remediation, is required as part of the approved remediation scheme then the monitoring and maintenance scheme will need to be approved in writing by the local planning authority. Following completion of the measures identified in that monitoring and maintenance scheme and when the remediation objectives have been achieved, reports that demonstrate the effectiveness of the monitoring and maintenance carried out must be produced, and submitted to the Local Planning Authority for approval. This must be conducted in accordance with current UK guidance including DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'. Reason: This condition is to ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors and protection of controlled waters in accordance with Policy D24 of the Local Plan.

The development shall be carried out in accordance with the air quality assessment (with reference to current national air quality objectives and guidance documents), which was submitted to the LPA for approval 07.02.2022 in accordance with and approved as DOC on 52/19/00001. If the assessment identifies the need to protect the future residential occupiers of the buildings from the effects of air-borne pollutants arising from road traffic a mitigation scheme shall be submitted to and approved in writing by the local planning authority. All works which form part of the approved scheme shall be completed prior to the occupation of the buildings hereby approved. Reason: This condition is pre commencement in order to safeguard the amenities of the occupiers of the proposed dwellings in respect of atmospheric pollution in accordance with Policy D24 of the Local Plan.

Other than laying out as defined within the informatives, the development of the site shall be carried out in accordance with the CEMP (Biodiversity) that was submitted on 08.02.2022 and approved as DOC on 52/19/00001. The approved CEMP shall be adhered to and implemented throughout the construction period strictly in accordance with the approved details, unless otherwise agreed in writing by the local planning authority. The development shall be carried out in accordance with the written commitment to the sourcing of local labour which was submitted to and approved in writing by the local planning authority on 07.02.2022 and approved as DOC on 52/19/00001. The written commitment, as a minimum, shall set out the following matters: i) The proportion of construction workers to be sourced from the local labour pool, ii) Work experience/ apprenticeship opportunities; iii) The proportion of local procurement and sourcing; iv) On-going skills development and training opportunities; v) The steps that will be taken to ensure that the above is implemented; vi) The operator shall maintain a record of i - v above and shall make that information available to the local planning authority at all reasonable times upon request. Reason: This condition is in accordance with policy D15 of the Local Plan. This matter needs to be agreed early in the development in order to ensure that local labour is used in the project from the start.

Prior to commencement of the school development (other than laying out as defined within the informatives) details of the surface water and sustainable urban drainage systems generally in accordance with the principles of the outline FRA/Drainage Strategy dated April 2019 shall be submitted to and approved in writing with the Local Planning Authority. The Development shall be carried out in accordance with the agreed details thereafter. Reason: This condition is pre commencement in the interests of the flood risk and to ensure appropriate drainage of the site in accordance with the agreed principles and Policy D1 of the Local Plan.

Pre commencement relating to the detailed application A strategy for monitoring walkers and walkers with dogs to the Brue Estuary and their effects on over wintering birds in the periods between October and March each winter shall be submitted and approved by the Local Planning Authority before any work above foundation level is commenced. The monitoring strategy should include remedial measures should an adverse effect occur and any required measures shall be fully implemented prior to the occupation of any dwelling. Reason: This condition is pre commencement in the interests of the integrity of European and Ramsar designated sites and in accordance with policy D20 of the Sedgemoor Local Plan.

The development shall be carried out in accordance with the assessment of the quality of surface water discharge and a scheme for adequate mitigation for the results of this assessment shall be carried out in accordancewith details that were submitted on 07.02.2022 and approved as DOC on 52/19/00001 by the Local Planning Aurthority. Prior to occupation Prior to first occupation, a "lighting design for bats" shall be submitted to and approved in writing by the local planning authority and implemented in accordance with the approved details. The strategy shall: a) identify those areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance along important routes used to access key areas of their territory, for example, for foraging; and b) show how and where external lighting will be installed (through the provision of lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent the above species using their territory. All external lighting shall be installed in accordance with the specifications and locations set out in the design, and these shall be maintained thereafter in accordance with the design. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: In the interests of the Favourable Conservation Status of populations of European protected species and in accordance with policy D20 of the Sedgemoor Local Plan

The development shall be undertaken in accordance with the Landscape and Ecological Management Plan (LEMP) and in accordance with details that were submitted on 08.02.2022 and approved as DOC on 52/19/00001. The content of the LEMP shall include the following: a) Description and evaluation of features to be managed [including biodiversity enhancements] b) Ecological trends and constraints on site that might influence management. c) Aims and objectives of management. d) Appropriate management options for achieving aims and objectives. e) Prescriptions for management actions. f) Preparation of a work schedule (including an annual work plan capable of being rolled forward over a five-year period). g) Details of the body or organization responsible for implementation of the plan. h) On-going monitoring and remedial measures. The LEMP shall also include details of the legal and funding mechanism(s) by which the long term implementation of the plan will be secured by the developer with the management body(ies) responsible for its delivery. The plan shall also set out (where the results from monitoring show that conservation aims and objectives of the LEMP are not being met) how contingencies and/or remedial action will be identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The approved plan will be implemented in accordance with the approved details. Reason: In the interest of the Favourable Conservation Status of populations of European protected species, the maintenance of UK protected and priority species and biodiversity generally during the life of the operational development and in accordance with policy D20 of the Sedgemoor Local Plan

The Landscaping shall be carried out in accordance with the soft landscaped details submitted and approved in writing with the Local Planning Authority 11/07/2022 under 52/21/00016. All landscaping shall be provided prior to the completion of the development. Any species dead/failing within a 5 year period following planting will be replaced to the satisfaction of the Local Planning Authority. Reason: In the interests of the visual amenities of the surrounding area and in accordance with Policies D2 and D19 of the Local Plan.

The development shall be carried out in accordance with the details of the kerbing and drainage that was submitted to and approved in writing by the Local Planning Authority 02.02.2023 under 52/21/00016. The development shall be carried out, retained and maintained in accordance with the agreed details. The following will be installed in consultation with a competent ecologist prior to the occupation of the 100th dwelling: a) Ten Schwegler 17b swift nest boxes (or similar to be agreed) will be installed under the eaves and away from windows on a north facing elevation of dwellings b) Ten Schwegler 1SP sparrow terraces (or similar to be agreed) will be installed under the eaves and away from windows on a north facing elevation of dwellings c) Five 3S Schwegler starling nest boxes (or similar to be agreed) will be installed on suitable trees on the site's boundaries The location of these shall be in accordance with the plan submitted and approved by the Local Planning Authority 10.11.2022 under 52/21/00016 which showed the locations of the boxes. Reason: In the interest of biodiversity enhancement as per the National Planning Policy Framework and policy D20 of the Sedgemoor Local Plan

Details of the connection point between the residential site and the school alongside a timetable for its delivery shall be submitted to and approved in writing by the LPA prior to the school being first brought into use. Reason: In the interests of accessibility in accordance with Policy D13 of the Local Plan.

Compliance No development hereby approved which shall interfere with or compromise the use of footpath BW 35/9 shall take place until a path diversion order has been made and confirmed. The alternative route shall be provided prior to the completion of the development in accordance with the agreed details to the satisfaction of the Local Planning Authority. Reason: To ensure accessibility to and through the public right of way in accordance with Policies D13 and D14 of the Local Plan.

The proposed roads, including footpaths and turning spaces where applicable, shall be constructed in such a manner as to ensure that each dwelling before it is occupied shall be served by a properly consolidated and surfaced footpath and carriageway to at least base course level between the dwelling and existing highway. Reason: In the interests of Highway Safety and in accordance with Policies D13 and D14 of the Local Plan.

No building shall be occupied or otherwise used for any purpose until properly consolidated and surfaced parking and turning spaces for vehicles have been constructed within the site in accordance with the approved plans. Such parking and turning spaces shall be kept clear of obstruction at all times and not used other than for the turning of vehicles in connection with the development hereby permitted. Reason: In the interests of Highway Safety and in accordance with Policies D13 and D14 of the Local Plan.

The recommendations listed in paragraph 4 of the noise survey carried out by Hepworth Acoustics (report No P18-448-R01v1) dated December 2018, and those contained within the additional information submitted by Hepworth Acoustics on 7 March 2019, shall be implemented in full prior to occupation. Reason: In the interests of the amenities of the adjoining properties/uses in accordance with Policies D24 and D25 of the Local Plan.

The residential dwellings hereby permitted shall be constructed with the finished floor levels of the dwellings set at a minimum of 6mAOD. Reason: To reduce flood risk to the development and future users and in accordance with Policy D1 of the Local Plan.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re- enacting that Order with or without modification ), no fences, gates or walls other than those hereby approved shall be erected within the curtilage of any dwellinghouse forward of any wall of that dwellinghouse which fronts onto a road. Reason: In the interests of the visual amenity of the surrounding area in accordance with Policy D2 of the Local Plan.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, or any statutory instruments revoking or re-enacting the Order with or without modification, the prior written permission of the local planning authority shall be obtained for any additions, extensions or alterations to the dwelling by the submission of a planning application. Reason: In the interests of the character and appearance of the building in accordance with Policy D2 of Local Plan.

The residential development hereby approved shall be carried out in accordance with the details contained within the Flood Risk Assessment and Drainage Strategy dated December 2018. Reason: In the interests of the flood risk and to ensure appropriate drainage of the site in accordance with the agreed principles and Policy D1 of the Local Plan.
