1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
Works to any of the buildings shall not in any circumstances commence unless the Local Planning Authority has been provided with either: a) a copy of the licence issued by Natural England pursuant to Regulation 55 of The Conservation of Habitats and Species Regulations 2017 authorising the development to go ahead; or b) a copy of a letter from Natural England confirming that the works fall within the remit of a Bat Mitigation Class Licence (WML-CL21) and that the site has been registered in accordance with the class licence; or c) a statement in writing from the licensed bat ecologist to the effect that he/she does not consider that the specified development will require a licence. Reason: A pre-commencement condition is in the interests of the strict protection of European protected species and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity.
4
All ecological measures and/or works (including mitigation and enhancements) shall be carried out in accordance with the Technical Note provided by Clarkson and Woods (10/10/2023) as already submitted with the planning application and agreed in principle with the Local Planning Authority prior to determination. Reason: In the interests of European and UK protected species and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity.
5
Where external lighting is to be installed, prior to construction above damp-proof course level, a lighting design for bats, following Guidance Note 08/23 - bats and artificial lighting at night (ILP and BCT 2023), shall be submitted to and approved in writing by the Local Planning Authority. The design shall show how and where external lighting will be installed. Lux levels should be below 0.5 Lux on key & supporting features or habitats. All external lighting shall be installed in accordance with the specifications and locations set out in the design, and these shall be maintained thereafter in accordance with the design. Under no circumstances should any other external lighting be installed without prior consent from the Local Planning Authority. Reason: In the interests of the 'Favourable Conservation Status' of populations of European protected species and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity.
6
Prior to the commencement of the development hereby approved, a Construction Management Plan (CMP) to manage the impacts of construction on, and ensure sensitive and unimpeded access for visitors to, the adjoining graveyard, during the life of the works, shall be submitted to and approved in writing by the Local Planning Authority. For the avoidance of doubt, the CMP shall, amongst other things, include:- a) Details of measures to ensure unimpeded access for visitors to the adjoining graveyard; b) Designated locations for the storage of materials, equipment or other construction items; c) Details of any site construction office, compound and ancillary facility buildings; d) A point of contact (such as a Construction Liaison Officer/site manager) and details of how complaints will be addressed, including an appropriate phone number. The details so approved and any subsequent amendments as shall be agreed in writing by the Local Planning Authority shall be complied with in full and monitored by the applicants to ensure continuing compliance during the construction of the development. Reason: This is a pre-commencement condition to ensure the unimpeded access is retained for visitors to the adjoining graveyard throughout the construction process.
