1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
As bat roosts will be destroyed and soprano pipistrelle bats potentially harmed the following is required to be conditioned in order that [Mendip] District Council fulfils its legal duty of 'strict protection' of European protected species under the provisions of the Habitats Regulations 2017 (and the Crime and Disorder Act 1998) [see end note]. The works to the dwelling house shall not in any circumstances commence unless the Local Planning Authority has been provided with either; a copy of the licence issued by Natural England pursuant to Regulation 55 of The Conservation of Habitats and Species Regulations 2017 authorising the development to go ahead; or a copy of a letter from Natural England confirming that the works fall within the remit of a Bat Mitigation Class Licence (WML-CL21) and that the site has been registered in accordance with the class licence – for bats only; a statement in writing from the licensed common pipistrelle and long eared bats ecologist to the effect that he/she does not consider that the specified development will require a licence. Reason: This is a pre-commencement condition in the interest of the 'strict protection' of European protected species and in accordance with Adopted Sedgemoor Local Plan Policy D20.
4
All ecological measures and works shall be carried out in accordance with the details contained in the Bat Survey Report (Avondale Ecology, June 2023) as already submitted with the planning application and agreed in principle with the Local Planning Authority prior to determination. A statement should be provided prior to first use of the development by the ecologist responsible to the Local Planning Authority to confirm that works have been suitably undertaken. Reason: In the interests of the strict protection of European protected species and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity.
5
Prior to first occupation of the extension hereby approved, the following biodiversity enhancement(s) will be installed on the/at the site: 1x Schwegler 1SP Sparrow terrace and 1x Woodstone Swift nest box to be installed within the new roof layout or attached externally under the eaves. The ideal position for bird boxes is at a height of at least 3m, away from windows and doors and north facing (followed by north-east, and then east if no other aspects are possible). Under no circumstances should south or west elevations be used, and boxes aimed at different species should be spaced at least 2m apart. A grassland/wildflower buffer of 2 or more meters to be planted and/or maintained around the boundary hedgerows. Reseeding should be undertaken using a native species mix such as Emorsgate EM2 or EM3 mix. Installation/construction of a deadwood log refugia pile as a shelter for reptiles, invertebrates, amphibians and small mammals. Advice can be found here: Log Piles for Wildlife | Garden Advice - The RSPB. This should be constructed within the boundary of the site and maintained thereafter Once installed, the biodiversity enhancement(s) shall thereafter be retained. Reason: In accordance with Government policy for the enhancement of biodiversity within development as set out in paragraph 174(d) of the National Planning Policy Framework and Sedgemoor Local Plan 2011-2032 policy D20.
6
Prior to the installation of any external lighting, a lighting design for bats, following Guidance Note 08/18 Bats and artificial lighting in the UK (ILP and BCT 2018), shall be submitted to and approved in writing by the Local Planning Authority. The design shall show how and where external lighting will be installed (including through the provision of technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb roosting or prevent bats using their territory. The design should accord with Step 5 of Guidance Note 08/18, including submission of contour plans illustrating Lux levels. Lux levels should be below 0.5 Lux. All external lighting shall be installed in accordance with the specifications and locations set out in the design, and these shall be maintained thereafter in accordance with the design. No other external lighting shall be installed without prior consent from the Local Planning Authority through submission of a planning application. Reason: In the interests of the 'Favourable Conservation Status' of populations of European protected species and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity.
