1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
Before the commencement of the development hereby permitted the applicant, or their agents or successors in title, shall have secured the implementation of a programme of archaeological work in accordance with a Written Scheme of Investigation (WSI) which has been submitted and approved in writing by the Planning Authority. The WSI shall include details of the archaeological excavation, the recording of the heritage asset, the analysis of evidence recovered from the site and publication of the results. The development hereby permitted shall be carried out in accordance with the approved scheme. Reason: This is a pre-commencement condition as the site lies in the Theale Area of High Archaeological Potential which encompasses the core settlement of Theale and earlier Romano British settlement, which extends across the valley, and the development therefore has the potential to disturb important archaeological remains, in accordance with Sedgemoor Local Plan 2011-2032 Policy D26.
4
Prior to the commencement of the development hereby approved, details of a scheme for the management of surface water based on sustainable drainage principles should be submitted to, and approved in writing by the local planning authority. The scheme shall be managed and maintained in accordance with the approved details for the lifetime of the development. Reason: To ensure the proposal does not increase flood risk in accordance with Sedgemoor Local Plan 2011-2032 Policy D1.
5
Any vegetation in the construction area should initially be reduced to a height of 10 centimetres above ground level by hand, brashings and cuttings removed and left for a minimum period of 48 hours of warm suitable weather (limited rain and wind, with temperatures of 10°C or above) before clearing to minimise the risk of harming/killing any reptiles and / or amphibians that may be present and to encourage their movement onto adjoining land in the active period. Once cut the vegetation shall be maintained at a height of 10cm or less for the period of construction. This work may only be undertaken between April and October. Reason: This is a pre-commencement condition in the interests of UK protected species and in accordance with policy D20 of the Sedgemoor Local Plan 2011-2032.
6
Prior to the first occupation of the dwelling hereby approve, a 'lighting design for bats' shall be submitted to and approved in writing by the local planning authority. The design shall show how and where external lighting will be installed (including through the provision of technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent bats using their territory or having access to their resting places. All external lighting shall be installed in accordance with the specifications and locations set out in the design, and these shall be maintained thereafter in accordance with the design. No other external lighting shall be installed without prior written consent from the local planning authority. Reason: In the interests of the Favourable Conservation Status of populations of European protected species and in accordance with policy D20 of the Sedgemoor Local Plan 2011-2032.
7
Prior to the first occupation of the dwelling hereby approved, the following biodiversity will be installed into the structure of or on the new dwelling or in the garden and maintained thereafter: Habitat 001 bat boxes or similar at least 4 metres above ground level and away from windows on the west and east elevation facing elevations; Two Schwegler 1SP Sparrow terraces or similar at least one metre apart directly under the eaves and away from windows on the north elevation; A bee brick built into the wall about 1 metre above ground level on the south facing elevation; and Two invertebrate and reptile habitat piles on the corners of the eastern boundary. Reason: In accordance with Government policy for the maintenance and enhancement of biodiversity within development as set out in paragraph 170(d) of the National Planning Policy Framework.
8
The dwelling hereby permitted shall be first occupied by the applicant Mr Andrew Landers as their sole or main residence. Reason: To ensure the development is implemented as a self-build proposal in accordance with Policies CO2 and D9 of the Sedgemoor Local Plan 2011-2032.
9
Before the dwelling hereby permitted is first occupied, a properly consolidated and surfaced access shall be constructed (not loose stone or gravel) over the first 6.0 metres. The access shall be maintained in that form thereafter at all times. Reason: In the interest of highway safety in accordance with Sedgemoor Local Plan 2011-2032 Policies D13 and D14.
10
Provision shall be made within the site for the disposal of surface water so as to prevent its discharge onto the highway. Such provision shall be installed before the first occupation of the dwelling hereby approved and thereafter maintained at all times. Reason: In the interest of highway safety in accordance with Sedgemoor Local Plan 2011-2032 Policies D13 and D14.
11
The area allocated for parking and turning on the submitted and approved Proposed Site Plan Drg No. 0744.P.003 rev C shall be kept clear of obstruction and shall not be used other than for parking and turning of vehicles in connection with the development hereby permitted. Reason: In the interest of highway safety in accordance with Sedgemoor Local Plan 2011-2032 Policies D13 and D14.
12
Any entrance gates erected shall be hung to open inwards, shall be set back a minimum distance of 6.0 metres from the carriageway edge and shall thereafter be maintained in that condition at all times.
