Conditions and Reasons

Condition

1
The proposed development would provide a permanent gypsy and traveller site for residential occupation within Flood Zone 3a. The development constitutes highly vulnerable development, which is inappropriate within this flood zone. In addition, the applicant has failed to demonstrate that the Sequential Test has been satisfied, that all sources of flooding affecting the site have been adequately assessed, or that future occupiers would remain safe during flood events for the lifetime of the development, including in respect of tidal flooding and the potential breach or failure of flood defences. The proposal is therefore contrary to policies F5, F6 and F7 of National Planning Policy Framework and policy D1 of the Sedgemoor Local Plan 2011-2032.
2
Insufficient ecological information has been provided to enable a robust assessment of the effects of the development on priority habitats, protected species and the wider ecological network. The development has resulted in the loss of Coastal and Floodplain Grazing Marsh Priority Habitat, whilst insufficient information has been submitted to demonstrate that the development would not result in unacceptable impacts upon protected species, adjacent watercourses and associated ecological interests. The proposal therefore conflicts with Policy D20 of the Sedgemoor Local Plan 2011-2032 and the biodiversity objectives of the NPPF.
