1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
No development shall commence until a scheme for the management of foul and surface water has been submitted to and approved by the Local Planning Authority showing how the new development will connect to the new surface water drainage system and discharge into the wider network. Surface water attenuation should be provided, demonstrating how the system operates during a 1 in 100 critical duration storm event. Appropriate allowance for climate change should be incorporated into the scheme in accordance with NPPF. Where infiltration forms part of the proposed stormwater system such as infiltration trenches and soakaways, soakage test results and test locations are to be submitted in accordance with BRE digest 365. Reason: In the interests of providing a satisfactory level of surface water drainage, improving water quality and to prevent flooding. It is necessary to understand the drainage scheme in detail prior to any initial construction works which may prejudice the surface water drainage strategy.
4
The Biodiversity Gain Plan to be submitted to the Local Planning Authority in accordance with Paragraphs 13 and 14 of Part 2 of Schedule 7A of the Town and Country Planning Act 1990 shall be broadly in accordance with the approved Biodiversity Gain Statement [Avondale ecology]. Reason: To ensure that the strategy for meeting the Biodiversity Net Gain requirements for the development does not change significantly following the grant of planning permission and to minimise the risk of significant post-permission viability issues arising due to Biodiversity Net Gain issues
5
A Habitat Management and Monitoring Plan (HMMP) shall be submitted to, and be approved in writing by, the Local Planning Authority prior to the commencement of the development. The content of the HMMP shall include details of how the habitat being created for BNG will be managed for 30 years, as well as the following details: Description and evaluation of features to be managed. Ecological trends and constraints on site that might influence management. Aims and objectives of management. Appropriate management options for achieving aims and objectives. Prescriptions for management actions. Preparation of a work schedule (including an annual work plan capable of being rolled forward over a five-year period). Details of the body or organization responsible for implementation of the plan. On-going monitoring and remedial measures. The approved plan will be implemented in accordance with the approved details. Reason: In the interests of the 'Favourable Conservation Status' of populations of European and UK protected species, UK priority species and habitats listed on s41 of the Natural Environment and Rural Communities Act 2006 and in accordance with Somerset District Council Local Plan - Policy EQ4 Biodiversity.
6
Prior to the installation of external lighting of the hereby approved outbuilding, a lighting design for bats, following Guidance Note 08/23 - bats and artificial lighting at night (ILP and BCT 2023), shall be submitted to and approved in writing by the Local Planning Authority. The design shall show how and where external lighting will be installed. Lux levels should be below 0.5 Lux on key & supporting features or habitats. All external lighting shall be installed in accordance with the specifications and locations set out in the design, and these shall be maintained thereafter in accordance with the design. Under no circumstances should any other external lighting be installed without prior consent from the Local Planning Authority.   Internal lighting should be recessed where installed in proximity to windows and blinds should be fitted to reduce glare and light spill (Institution of Lighting Professionals & the Bat Conservation Trust 2018). No illumination above the current lux levels or above 0.5lux to all retained and new hedgerows and the scrub to provide dark corridors through and around the site. No illumination of any bat roost provision within the development (i.e bat boxes on buildings) Reason: In the interests of the 'Favourable Conservation Status' of populations of European protected species and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity
7
The proposed development falls within 10 meters of a known water course. There is potential for negative impacts to arise (dust, silt runoff, chemical) if avoidance measures are not implemented prior to works commensing.  A Risk Avoidance Measures Method Statement (RAMMS) detailing a strategy to prevent adverse dust levels(water spray, wetting ground);silt runoff (silt netting); run off from chemical liquids such as petroleum and detergents (bunding) into the nearby watercourse which is located to the northern end to the application site; and using bunded storage for example when refuelling vehicles and storing oil and fuel accordingly shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. The development will thereafter be implemented in accordance with the approved strategy. Pollution prevention measures; Waste to be secured within the site and managed appropriately; No refuelling of equipment, machinery or vehicles within 10m of the rhyne; Edge of the rhyne banks to be demarcated e.g. using Heras fencing or warning tape before works commence and contractors instructed not to access this area; No parking along or driving over the grassed banks of the rhyne; and No discharge of any water or waste into the rhyne Reason: Pre-commencement condition: In the interests of European and UK protected species. UK priority species and habitats listed on s41 of the Natural Environment and Rural Communities Act 2006 and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity
8
Retained hedgerows and trees shall be protected from mechanical damage, pollution incidents and compaction of roots in accordance with BS5837:2012 during site clearance works, groundworks and construction and to ensure materials are not stored at the base of trees, hedgerows and other sensitive habitats. Photographs of the measures shall be submitted to the Local Planning Authority prior to the commencement of any vegetative clearance or groundworks. The measures shall be maintained throughout the construction period. Reason: A pre-commencement condition in the interests of European and UK protected species and biodiversity generally and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity

The following will be incorporated into the site proposal with photographs of the installed features submitted to the Local Planning Authority prior to first occupation:  Habitat piles could be created including compost heaps, log, brash or stone piles close to hedgerows. Standing deadwood of trees should be retained as decay progresses, where this does not cause a health and safety hazard. Hedgehog connectivity (gaps of more than 13cm x 13cm) should be created through new solid boundaries. Features for nesting birds such as a house sparrow terrace or general nest box could also be mounted onto the exterior of the shed as an enhancement measure (see RSPB Sparrow Terrace Nest Box - RSPB Shop). Nest boxes should be sited at 2m+ above ground level. All boxes should be site in a location where they are unlikely to be disturbed or accessible to predators and ideally on a north facing elevation or out of direct sunlight as much as possible. At least one bat roost feature could be included into a new wall or roof structure if features above 3m from ground level are suitable. The feature could comprise an enclosed off-the[1]shelf option such as a Schwegler 2FR bat tube (www.nhbs.com/title/162812/2fr-schwegler[1]bat-tube) or Habitat inbuilt bat box (www.habibat.co.uk). A bat box could be incorporated into any new soffits or fascias (see www.wildcareshop.com/soffit-bat-box.html) or a bespoke roosting opportunity created by leaving 2-3cm access gaps or holes under a fascia board. Ideally, the soffit would be wood or rough-surfaced (i.e. no uPVC) for this option to be most effective. The feature should be at least 3m above ground level and ideally south or west facing. It should be located away from external lighting. These features would not risk any conflicts between bats and humans as roosts would be self contained. Wooden or woodcrete bat boxes attached to the exterior are not recommended as they degrade over time or can be easily displaced. Reason: In accordance with Government policy for the enhancement of biodiversity within development as set out in paragraph 186 of the National Planning Policy Framework
