Conditions and Reasons

Condition

1
The principle of residential development in this countryside location is unacceptable, as it does not fulfil a defined housing need and does not include any local infrastructure priorities as agreed with the Nether Stowey Parish Council. The development is not acceptable under any other exceptional criteria and would therefore be in conflict with Policies S1, S2, T2b and C01 of the adopted Sedgemoor Local Plan 2011-2032 and is therefore unacceptable.
2
No specific justification has been submitted for the proposed retail facility on site and that this need could not be fulfilled in existing facilities in the village of Nether Stowey, and as such the proposal is in conflict with Policy D35 of the adopted Sedgemoor Local Plan 2011-2032 and is therefore unacceptable.
3
The proposal would result in a substantial urbanising effect in what is currently an open, agricultural field in a prominent location visible from the Quantocks Hills AONB (National Landscape) without adequate mitigation given the location of the existing sewer easement on the western edge of the site. The proposal therefore conflicts with Policy D19 of the adopted Sedgemoor Local Plan 2011-2032 and Policy E4 of the adopted Nether Stowey Neighbourhood Plan and as such is unacceptable.
4
The proposed ecological mitigation in the form of landscaping planting buffers to the western edge of site cannot be implemented due to the location of a sewer easement. This will result in an inability to achieve low level lighting and planting for bats commuting from the Exmoor and Quantocks SAC contrary to Policy D20 of the adopted Sedgemoor Local Plan 2011-2032, and paragraph 174 of the NPPF. Furthermore, the proposals fail to protect a European Protected Species and are therefore contrary to Regulation 63 of the Conservation of Habitats and Species Regulations 2017.
5
There is insufficient information submitted to fully assess the impacts of the proposal on the archaeological heritage assets and as such the proposals are contrary to Policy D26 of the adopted Sedgemoor Local Plan 2011-2032 and paragraphs 205-29 of the NPPF
6
The proposals are not supported by a S106 obligation for the following: works to the highway including a toucan pedestrian crossing, affordable housing at 40% provision, provision of a local equipped area of play on site and provision of £580 per dwelling for NHS primary care services.
