1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
The Biodiversity Gain Plan to be submitted to the Local Planning Authority in accordance with Paragraphs 13 and 14 of Part 2 of Schedule 7A of the Town and Country Planning Act 1990 shall be broadly in accordance with the approved Biodiversity Gain Statement [July 2025]. Reason: To ensure that the strategy for meeting the Biodiversity Net Gain requirements for the development does not change significantly following the grant of planning permission and to minimise the risk of significant post-permission viability issues arising due to Biodiversity Net Gain issues
4
A Habitat Management and Monitoring Plan (HMMP) shall be submitted to, and be approved in writing by, the Local Planning Authority prior to the commencement of the development. The content of the HMMP shall include details of how the habitat being created for BNG will be managed for 30 years, as well as the following details: a) Description and evaluation of features to be managed. b) Ecological trends and constraints on site that might influence management. c) Aims and objectives of management. d) Appropriate management options for achieving aims and objectives. e) Prescriptions for management actions. f) Preparation of a work schedule (including an annual work plan capable of being rolled forward over a five-year period). g) Details of the body or organization responsible for implementation of the plan. h) On-going monitoring and remedial measures. The approved plan will be implemented in accordance with the approved details. Reason: In the interests of the 'Favourable Conservation Status' of populations of European and UK protected species, UK priority species and habitats listed on s41 of the Natural Environment and Rural Communities Act 2006 and in accordance with Somerset District Council Local Plan - Policy EQ4 Biodiversity.
5
The following Reasonable Avoidance and Mitigation Measures (RAMMS) shall be followed: Area within the construction footprint of the barn to be strimmed or mown (using a mower set to at least 15cm above ground level) before works commence. This will allow any species such as basking reptiles or small mammals to disperse before work commence. Any excavations over 1m deep to be covered overnight or fitted with an escape ramp to allow any small mammals which fall in to escape. Artificial lighting to be sensitively designed (if required). Measures include: Only using external lighting where absolutely necessary for safety reasons and ideally avoiding using external lighting altogether; All external lighting to be fitted with PIR sensors and short-duration timers (less than 2 minutes); Avoiding floodlighting and choosing downward-facing, wall-mounted directional fittings; Warmer light colours below 2700K to be used; and Light spill onto adjacent hedgerows to remain below 0.5 lux. Confirmation of the works by the ecologist should be submitted to the Local Planning Authority within one week of completion. Reason: To ensure the strict protection of European protected species and in accordance with Sedgemoor District Council Local Plan: Policy D20 - Biodiversity and Geodiversity
6
As enhancement and compensation measures, and in accordance with National Planning Policy Framework (NPPF), please apply the following conditions to any planning permission granted. The following will be incorporated into the site proposal with photographs of the installed features submitted to the Local Planning Authority prior to first occupation: Roost feature in new soffit/fascias created by leaving 2-3cm access gaps or holes or installing a soffit bat box (see www.wildcareshop.com/soffit-bat-box.html). Ideally, the soffit would be wood or rough-surfaced (i.e. not uPVC) for this option to be most effective; Bat tubes such as Schwegler 1FR; Bat bricks such as Ibstock brick or Habibat box; Lifted tiles, providing bitumen type 1F underlay is used, and not breathable roofing membrane as this can cause entanglement of bats; or Attached bat boxes such as Schwegler 2FE or Beaumaris woodstone boxes, although these often degrade more repidly or become detached over time. Boxes could also be installed on a nearby tree if no suitable locations are present within the building. Reason: In accordance with Government policy for the enhancement of biodiversity within development as set out in paragraph 186 of the National Planning Policy Framework
