Conditions and Reasons

Number
Condition
Complied Date
1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
The holiday cottages hereby approved shall not be occupied until the farm stay element (agricultural buildings / animal shelters) as shown on the approved plan (drg. no. JSC/2466/16/04) of the development have been completed. Reason: To ensure the development's associated farm diversification benefits are realised.
4
a) The Holiday Cottages shall be occupied for holiday purposes only and shall not be occupied as a person's sole or main residence. b) The Holiday Cottages shall not be occupied by the same person or family for more than 3 months in any 12 month period. c) The site operator and owners shall maintain an up to date register of the names of all owners/occupiers, including their guests, and evidence of their main home addresses, and shall make this information available at all reasonable times to the local planning authority. Reason: The site is not considered suitable for permanent accommodation.
5
The development hereby permitted shall be constructed with Finished Floor Levels set at a minimum of 5.9m AOD. Reason: To reduce the residual impact of flooding on the proposed development.
6
The development shall proceed in accordance with the Flood Warning and Evacuation Plan (FWEP) dated 21 April 2017. Reason: To reduce the residual impact of flooding on the proposed development and to protect the occupiers of the development.
7
Prior to commencement of the development, details of the scheme for the management of surface water and foul water should be submitted to, and approved in writing by the Local Planning Authortiy in conjunction with the Axe Brue Drainage Board. Reason: To ensure that the development is served by an adequate system of surface water attenuated drainage without detriment to adjoining land and properties, and that adequate maintenance is maintained.
8
Prior to completion, a 'lighting design for bats' shall be submitted to and approved in writing by the local planning authority. The strategy shall show how and where external lighting will be installed (through the provision of technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent the above species using their territory. All external lighting shall be installed in accordance with the specifications and locations set out in the design, and these shall be maintained thereafter in accordance with the design. Under no circumstances should any other external lighting be installed without prior consent from the local planning authority. Reason: Individual bats are afforded protection from intentional or reckless disturbance to individual bats under the Wildlife and Countryside Act 1981 (as amended). Bat species are adversely affected by the introduction of artificial lighting on commuting routes, which in effect can cause severance between roosts and forging areas. A dark boundary area will also help maintain other light sensitive species on site and contribute towards conserving biodiversity.
9
No removal of hedgerows, trees or shrubs shall take place between 1st March and 31st August inclusive, unless a competent ecologist has undertaken a careful, detailed check of vegetation for active birds' nests immediately before the vegetation is cleared and provided written confirmation that no birds will be harmed and/or that there are appropriate measures in place to protect nesting bird interest on site. Any such written confirmation should be submitted to the local planning authority. Reason: The ecological report states that there is potential for nesting birds on site. Nesting birds are afforded protection under the Wildlife and Countryside Act 1981 (as amended).
10
The sewage package treatment plant shall be designed to provide satisfactory drainage to be able to cope with the maximum occupancy of all residential units. Reason: To reduce the risk of nuisance caused by ineffective drainage
11
No construction work involving noisy activities (such as the use of power tools/hammering) or deliveries to and from the site shall take place outside the hours of 07:00 to 18:00 Mondays to Fridays, 08:00 to 13:00 on Saturdays, with the exception of specific works which shall have been agreed in advance and in writing by the local planning authority and shall include details of the task, the date and duration of works. No works to take place on Sundays and Bank Holidays. Reason: To protect the amenity of local residents from potential impacts whilst site clearance, groundworks and construction is underway.
12
The applicant shall submit an Odour Management Plan to be approved by the Planning Authority prior to the keeping of any animals and for it to be implemented thereafter. Reason: To protect the amenity of occupiers of adjoining properties from excessive odour.
13
Prior to the occupation of development, a detailed landscaping scheme shall be submitted to and approved in writing by the local planning authority. Such a scheme shall include detailed planting plans and specifications, together with management and maintenance arrangements. Thereafter the approved landscaping scheme shall be implemented within the first available planting season. The trees/shrubs shall be protected and maintained, and dead or dying trees/shrubs shall be replaced to the satisfaction of the local planning authority for a period of five years following their planting. Reason: In the interests of the character and visual amenities of the area.
14
The proposed access shall be constructed in accordance with details shown on the submitted plan, Dwg No : JSC/2466/17/10, and shall be available for use before occupation.   Once constructed the access shall be maintained thereafter in that condition at all times. Reason: In the interests of highway safety.
15
Prior to occupation of the development hereby permitted the proposed access over at least the first 6 metres of its length, as measured from the edge of the adjoining carriageway, shall be properly consolidated and surfaced (not loose stone or gravel) in accordance with details which shall have been submitted to and approved in writing by the Local Planning Authority. Once constructed the access shall thereafter be maintained in that condition at all times. Reason: In the interests of highway safety.
16
Provision shall be made within the site for the disposal of surface water so as to prevent its discharge onto the highway, details of which shall have been submitted to and approved in writing by the Local Planning Authority prior to the commencement of development.  Such provision shall be installed before occupation and thereafter maintained at all times. Reason: In the interests of highway safety.
17
The area allocated for parking and turning on the submitted plan, Dwg No : JSC/2466/17/10, shall be kept clear of obstruction and shall not be used other than for parking and turning of vehicles in connection with the development hereby permitted. Reason: In the interests of highway safety and to ensure that the development is has adequate parking provision.
18
At the proposed access there shall be no obstruction to visibility greater than 600 millimetres above adjoining road level within the visibility splays shown on the submitted plan. Dwg No : JSC/2466/17/10 Such visibility splays shall be constructed prior to the commencement of the development hereby permitted and shall thereafter be maintained at all times. Reason: In the interests of highway safety.
