Planning permission 32/19/00002 granted consent for "Change of use of land to site 5 holiday lodges and formation of parking, access and amenity area." The information submitted states that the use of land as a caravan site is lawful. However, it is not considered that the type of development permitted under 32/19/00002 would have resulted in the formation of a caravan site as the lodges as approved would not have fallen within the definition of a caravan due to their size exceeding the parameters as set out within Section 13 of the Caravan Sites Act 1968. The evidence provided is insufficient for the Authority to be satisfied, on the balance of probability, that the original planning permission 32/19/00002 was commenced within 3 years of the date of the permission and therefore the development as carried out on the site to date does not benefit from planning permission and is unlawful.
