The access track for which no reasonable justification has been provided, has resulted in the loss of trees, the opening up of the southern side of Pightley Lane and the laying of inapproprate materials, which fail to preserve or enhance the special character and visual quality of the designated Quantock Hill AONB. The development provides no overriding reason with which to retain the track and therefore does not outweigh the detrimental impact and harm caused to the designated and protected area. The works constructed and submitted are therefore contrary to Policies D2 and D19 of the Sedgemoor District Local Plan.

The access as constructed is located within a position whereby steep banks are located immediately adjacent to it and therefore results in insufficient visibility being provided when exiting the site. The use of the access and the means of its construction has resulted in mud, stones and detritus being dispersed onto Pightley Lane as well as insufficient means of surface water management being provided. Therefore the works as carried out result in a detrimental impact on highway safety and contrary to Policy D14 of the Sedgemoor Local Plan.

It is essential that the presence or otherwise of protected species, and the extent that they may be affected by development, is established, otherwise all relevant material considerations may not have been addressed in making the decision. No ecological assessment has been provided with the application to ascertain the potential impact on protected species and their habitats and therefore the application is contrary to Policy D20 of the Sedgemoor Local Plan
