Conditions and Reasons

Number
Condition
Complied Date
1
The building was erected following the granting of planning permission 25/22/00022 and was subject to condition 3, which required the building to "be used for agricultural storage only..." As such the condition sets out that the future use of the building would be for agricultural storage only and therefore the prior approval as submitted would be contrary to the General Permitted Development Order 2015, (Permitted Development - 3.(4), which states: "Nothing in this Order permits development contrary to any condition imposed by any planning permission granted or deemed to be granted under Part 3 of the Act otherwise than by this Order."
2
The application site is located in Flood Zone 3, an area deemed as being at a high risk of flooding and the proposed dwelling would be a 'more vulnerable' use. The barn is single storey and the proposed change of use to a dwelling would lack a means of escape, which means that any occupier does not have a safe place to go in times of a flood. As a consequence the development increases the risk to life of any potential occupants. The application is therefore contrary to Section 14 of the National Planning Policy Framework and guidance within the Planning Practice Guidance relating to Flood Risk and Coastal Change.
