The hours of working shall be limited to 07.00 to 19.00 throughout the week. Reason: To safeguard local residents from noise and disturbance during unsociable hours in accordance with POlicy D16 of the adopted Sedgemoor Core Strategy.
3
The operation of the development hereby permitted shall be carried out in accordance with the noise attenuation requirements set out in Section 7 and the conclusions 8.2 and 8.3 in Section 8 (which include reference to any future anaerobic digester) of the Environmental Noise Assessment dated 14 April 2018 and thereafter retained as such. Reason: In order to safeguard the local amenity of the area in accordance with Policy D16 of the adopted Core Strategy.
4
No system of public address, loudspeaker system or amplified music shall be operated within the site without prior written permission of the local planning authority. Reason: To safeguard local residents from noise and disturbance in accordance with Policy D16 of the adopted Sedgemoor Core Strategy
5
Prior to the use of the development first being brought into use details of any proposed external lighting shall be submitted to and approved in writing by the Local Planning Authority. The development shall be implemented in accordance with the approved details. Any external lighting must only directly illuminate the application site and should be designed so as to prevent light pollution to the river corridor. Reason: To ensure that any proposed lighting is appropriate for its location taking into account the need to prevent light pollution to the river corridor which could affect a number of protected species and the need to protect residents from obtrusive light. The condition seeks compliance with the requirements of Policies D14 and D16 of the adopted Sedgemoor Core Strategy.
6
The development hereby permitted shall be carried out and operated in accordance with local labour commitment as set out within the letter dated 10 July 2018. The operator shall maintain a record of local labour and shall make that information available to the local planning authority at all reasonable times upon request. Reason: In accordance with policy D11 of the Sedgemoor Core Strategy (2006-2027).
7
The development hereby permitted shall be constructed with finished floor levels set at a minimum of 5.2m AOD above existing ground levels. Reason: To reduce the impact of flooding on the proposed development in accordance with paragraph 17 and section 10 of the National Planning Policy Framework, Paragraph 103 of the National Planning Policy Framework and the Technical Guidance to the National Planning Policy Framework (March 2015).
8
No removal of trees or shrubs shall be carried out in the bird nesting season, between 01 March and 31 August. If this is not possible a survey for nesting birds shall be carried out immediately prior to commencement of the works by a suitably qualified ecologist and the details, together with proposed mitigation measures shall be submitted to and approved in wrting by the local planning authority. Any nesting birds discovered will be buffered by an exclusion zone determined by the ecologist which will remain in force until the chicks have fledged. Reason: The submitted Phase 1 Habitat and Species Survey report states that there is potential for nesting birds on site within trees and shrubs. Nesting birds are afforded protection under the Wildlife and Countryside Act 1981 (as amended). Although this is a legal obligation the law does not specify a time period – some species can breed outside the time frame given. The condition seeks compliance with relevant legislation and Policy D14 of the adopted Sedgemoor Core Strategy
9
The existing trees on the site shall be fenced with protective fencing, as detailed on the submitted plan no.J00228.1 Rev D - Indicative Hard and Soft Landscaping Scheme, and shall not be removed for the duration of the development unless agreed by the Local Planning Authority. Reason: The submitted Phase 1 Habitat and Species Survey states that there is potential for nesting birds and bat feeding transit within the trees on the site and therefore protection of these trees during construction and development should be established in accordance with Policy D14 of the adopted Sedgemoor Core Strategy.
10
The mitigation measures as set out within Section 3 and table 3.1 of the Bat and Bird Survey and Mitigation Report dated 24 January 2018 shall be carried out in full prior to the occupation of the development hereby permitted and retained on site as such thereafter. Reason: The Phase 1 Habitat and Species Survey identifies that there is evidence of nesting birds on the site. The Survey also identifies a potential feeding corridor for bats. Both nesting birds and bats are protected under the Wildlife and Countryside Act 1981 (as amended). Incorporating appropriate design measures into the buildings will assist in mitigating the impact of the development on protected species and is necessary in accordance with Policy D14 of the adopted Sedgemoor Core Strategy.
11
No part of the development hereby permitted shall be occupied or brought into use until the highway works shown on the approved plan no.J00228.1 rev D (Indicative hard and soft landscape scheme) have been carried out and fully implemented in accordance with the approved details. Reason: In the interests of highway safety and in accordance with Policies D9 and D10 of the adopted Sedgemoor Core Strategy
12
The proposed access, footpaths and turning spaces where applicable, shall be constructed in such a manner as to ensure that the development hereby approved before it is occupied shall be served by properly consolidated and surfaced footpath and carriageway the development and existing highway. Reason: In the interest of the safety and convenience of all users of the highway and in accordance with Policies D9 and D10 of the adopted Sedgemoor Core Strategy.
13
The area allocated for parking and turning on the approved plan (Drg.no AL-00-00) shall be kept clear of obstruction and shall not be used other than for the parking and turning of vehicles in connection with the development hereby permitted. Reason: In the interests of highway safety in accordance with Policies D9 and D10 of the adopted Core Strategy
14
At the proposed access there shall be no obstruction to visibility greater than 600 millimetres above adjoining road level in advance of lines drawn 2.4 metres back from the carriageway edge on the centre line of the access and extending to points to the edge of carriageway 45m either side of the access. Such visibility shall be fully provided before the development hereby permitted is brought into use and shall thereafter be maintained at all times. Reason: In the interests of highways safety and in accordance with Policies D9 and D10 of the adopted Sedgemoor Core Strategy
