1
The proposed boundary wall by means of design and height would result in a detrimental visual impact upon the open character and appearance of the locality and therefore would be contrary to Policies D2 and D19 of the Sedgemoor District Council Local Plan (2011 and 2032) and para 130 of the National Planning Policy Framework (NPPF).
2
The proposal is contrary to Section 9 of the National Planning Policy Framework (NPPF) and Policy D14 of the Sedgemoor District Council Local Plan (2011 and 2032) since inadequate information has been submitted to satisfy the Local Planning Authority that since the proposed development would provide the necessary visibility splays to a neighbouring access as well as the development property which are essential in the interests of highway safety.
3
The proposal is contrary to Section 9 of the National Planning Policy Framework (NPPF) and Policy D14 of the Sedgemoor District Council Local Plan (2011 and 2032) since the proposed development would be prejudicial to highway safety given that the boundary and gates would be too close to the A38 carriageway for vehicles to stand clear.
4
It has not been satisfactorily demonstrated that the land subject to the application is completely within the control of the applicant, despite the applicant having only signed Certificate A. Parts of the site are within third party ownership and details of the correct notices to have been served have not been provided. Any permission would not be lawful if the correct notices have not been served.
