1
The development hereby permitted shall be begun no later than 21st July 2019. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
Prior to the commencement of any demolition operatives should be inducted by a licensed bat ecologist to make them aware of the possible presence of bats, their legal protection and of working practices to avoid harming bats. Reason: Bats and their roosts are afforded protection under the Conservation of Habitats and Species Regulations 2010 which includes making it illegal to cause kill or injure bats and destroy, damage or disturb roosts, and from intentional or reckless disturbance to individual bats under the Wildlife and Countryside Act 1981 (as amended). Bat species are adversely affected by the introduction of artificial lighting at roost sites and on commuting routes.
4
Renovation works will proceed using a 'soft' approach and key stages will be overseen by a licenced bat ecologist. Tiles and roof panels will be removed in a vertical rather than horizontal sliding motion. Any masonry and timber work will be dismantled using a 'soft' approach taking care with wall cavities, where present. In the event that any bats are found during development works, these will be translocated by a licensed bat consultant to the new bat box that has been preinstalled on a nearby tree.
5
A bat box (type Schwegler 1FF) will be installed, prior to the first occupation of the development hereby permitted, by a licensed bat ecologist within a semi-mature tree that occupies land just to the north of the development but under the same ownership (tree grid reference ST 3820 5536). This will be maintained in situ thereafter.
6
Prior to the installation of any lighting an external lighting scheme shall be submitted to, and approved in writing by, the Local Planning Authority. No artificial lighting associated with the development will illuminate features used by bats or installed bat roosts. The development shall proceed in accordance with the approved plans.
7
No work shall be carried out in the bird nesting season, which is approximately between April and September. If not possible a survey for nesting birds shall be carried out immediately prior to commencement of the works by a suitably qualified ecologist. Any nesting birds discovered will be buffered by an exclusion zone determined by the ecologist which will remain in force until the chicks have fledged Reason: Reason: The ecological report states that there is evidence of nesting swallows within the existing buildings. Nesting birds are afforded protection under the Wildlife and Countryside Act 1981 (as amended). Although this is a legal obligation the law does not specify a time period – some species can breed outside the time frame given.
8
Prior to the first occupation of the development hereby approved, a scheme showing provision for nesting for swallows shall be submitted to, and approved in writing by, the Local Planning Authority. The agreed scheme shall be implemented within one year of approval and retained in perpetuity. Reason: To ensure the development contributes to the Government's target of no net biodiversity loss and to provide gain where possible as set out in the National Planning Policy Framework.
