Conditions and Reasons

Condition

1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
A survey for nesting birds shall be carried out immediately prior to commencement of the works by a suitably qualified ecologist. Any nesting birds discovered will be buffered by an exclusion zone determined by the ecologist which will remain in force until the chicks have fledged Reason: The ecological report states that there is potential for nesting birds within hedgerows. Nesting birds are afforded protection under the Wildlife and Countryside Act 1981 (as amended). Although this is a legal obligation the law does not specify a time period – some species can breed outside the time frame given.
4
Any vegetation to be removed should initially be reduced to a height of 10 centimetres above ground level by hand, brashings and cuttings removed and the remainder left for a minimum period of 48 hours of fine warm weather before clearing to minimise the risk of harming/killing any reptiles that may be present and to encourage their movement onto adjoining land. This work may only be undertaken during the period between April and October. Reason: Reptile species are afforded protection from intentional and reckless killing or injury under the Wildlife and Countryside Act 1981 (as amended). Outside the period from April to October these species are likely to in torpor or hibernation when disturbance is likely to pose a risk to survival.
5
A buffer zone of at least 2 metres from hedgerows should be temporarily fenced during the construction period to protect hedgerow trees and roots from unnecessary damage and compaction Reason: In the interests of biodiversity.
6
An new mixed hedgerow of approximately 120 metres long shall be created and maintained along the entire north-eastern boundary of plots 1 to 3. The new hedgerow shall be planted utilising a native, conservation grade hedge species mix of local provenance and should comprise 50% hawthorn and blackthorn, and at least 3 further native hedge species and maintained in an A shape at a minimum height of 2.5 metres. Stock-proof fencing should be installed to protect the new hedgerow from grazing animals where appropriate. Should any hedge plants fail to survive, the gaps in the hedgerow should be replanted. Reason: To ensure the development contributes to the Government's target of no net biodiversity loss and gain where possible as set out in the National Planning Policy Framework; Sedgemoor District Council Core Strategy Policy D14; and the council's obligations for biodiversity under the Natural Environment and Rural Communities Act 2006.
7
The existing hedgerow along the south west boundary of the site shall be retained in situ in accordance with plan no.1685/02 as an integral part of the development hereby permitted and any dead or dying sections of the hedgerow shall be replaced to the satisfaction of the Local Planning Authority. Reason: In the interests of visual amenity.
8
The site shall only be occupied by persons who comply with the definition of gypsies or travellers as outlined in annex one of Planning Policy for Traveller Sites (PPTS). Reason: The local planning authority is only prepared to make an exception to countryside policies on the basis of the specific status of gypsies/travellers.
9
The accommodation hereby permitted shall be used solely in connection with the use of the existing mobile home as a single family dwelling and shall not be used as a separate unit of accommodation or business use whatsoever. Reason: The site is in the open countryside where development is strictly controlled and in the interests of clarifying the extent of the planning permission.
