Conditions and Reasons

Number
Condition
Complied Date
1
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2
The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.
3
Before the development hereby permitted is brought into use a replacement hedgerow adjacent to the new access shall be planted within nine months from the date of commencement of the development in accordance with the Sedgemoor Native Hedgerow Planting Pattern. The hedgerow shall be protected and maintained, and dead or dying sections shall be replaced to the satisfaction of the local planning authority for a period of five years following their planting. Reason: In the interests of visual amenity.
4
The driveway hereby permitted shall be constructed of a geocell system finished in gravel unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure the health of the existing trees within the site by reducing the loading on their roots.
5
No work shall be carried out in the bird nesting season, which is approximately between March and August. If not possible a survey for nesting birds shall be carried out immediately prior to commencement of the works by a suitably qualified ecologist. Any nesting birds discovered will be buffered by an exclusion zone determined by the ecologist which will remain in force until the chicks have fledged Reason: The ecological report states that there is evidence of nesting birds on site both on buildings and within trees. Nesting birds are afforded protection under the Wildlife and Countryside Act 1981 (as amended). Although this is a legal obligation the law does not specify a time period – some species can breed outside the time frame given
6
Before the access hereby permitted is first brought into use the access over at least the first 5.0 metres of its length, as measured from the edge of the adjoining carriageway, shall be properly consolidated and surfaced (not loose stone or gravel) and once constructed the access shall thereafter be maintained in that condition at all times. Reason: In the interests of highway safety.
7
Any entrance gates erected shall be hung to open inwards, shall be set back a minimum distance of 5.0 metres from the carriageway edge and shall thereafter be maintained in that condition at all times. Reason: In the interests of highway safety.
8
The gradient of the proposed access shall not be steeper than 1 in 10. Once constructed the access shall thereafter be maintained in that condition at all times. Reason: In the interests of highway safety.
9
Provision shall be made within the site for the disposal of surface water so as to prevent its discharge onto the highway, details of which shall have been submitted to and approved in writing by the Local Planning Authority. Such provision shall be installed before the access is first brought into use and thereafter maintained at all times. Reason: In the interests of highway safety.

10
At the proposed access there shall be no obstruction to visibility greater than 600 millimetres above adjoining road level within the visibility splays shown on the submitted plan. Such visibility splays shall be constructed prior to the commencement of the use of the access hereby permitted and shall thereafter be maintained at all times. Reason: In the interests of highway safety.
