The site is situated within the Burnham-on-Sea Conservation area and the design and scale of the removable ice cream kiosk is of a modern, flat roofed shipping container style and not a traditional Victorian, well-proportioned garden structure. It does not reflect the character of the historic sea front and is harmful to the setting of the Conservation Area and as such would be inappropriate to grant consent for the permanent siting of the structure. The proposal is contrary to Policies D2 and D26 of Sedgemoor's Local Plan.
