The proposed Certificate of Lawfulness is refused as the Local Planning Authority considers that the proposed change of use from a 6-bedroom, 6-person House in Multiple Occupation (Use Class C4) to a 6-bedroom, 7-person House in Multiple Occupation (sui generis) would constitute a material change of use of the property. As the proposed use falls outside the scope of the permitted development rights afforded by the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), it requires express planning permission from the Local Planning Authority. Accordingly, the Authority is not satisfied that the proposed use would be lawful in the absence of planning permission, and the application is therefore refused.
