The introduction of the proposed building to the rear of the existing retail unit would alter the existing access arrangements to the rear of the existing retail unit at 27-28 Cornhill. 27-28 Cornhill forms part of the Primary Retail Frontage within the Town Centre and insufficient evidence has been submitted to demonstrate that the proposed development would not undermine the efficient, effective and safe operation of the existing retail unit at 27-28 Cornhill. As such, the proposed development is considered contrary to Sedgemoor Local Plan 2011-2032 Policy D18 which seeks to protect the vitality, viability and retail function and character of the Town Centre, Local Plan 2011-2032 Policy D2 which seeks to deliver buildings, places and spaces that are safe and accessible to all and the National Planning Policy Framework.

Plan references 1392/4001 Rev C and 1392/4033 Rev A include notes identifying the introduction of solar panels to the flat and pitched roof. However, insufficient information has been submitted to demonstrate that the proposed solar panels would avoid harm to, sustain or enhance the significance of the Conservation Area contrary to Local Plan 2011-2032 Policy D26 which requires sufficient information to understand the significance of the heritage asset and how it will be potentially affected, Local Plan 2011-2032 Policy D2 which requires developments to demonstrate through the submission of information, how it maximises its contribution to the relevant principles, which includes a consideration of historic character and assets particularly in conservation areas and the National Planning Policy Framework.

The proposed development has failed to satisfactorily address the change in levels between external and internal spaces resulting in an inaccessible development which would not represent inclusive design accessible to all users. As a result, the proposed development is contrary to Local Plan 2011-2032 Policy D2 which seeks to deliver buildings, places and spaces that are safe and accessible to all and the National Planning Policy Framework.

The poor spatial relationship between the proposed residential units and the existing House in Multiple Occupation (HMO) at 27-28 Cornhill results in a poor standard of amenity for future occupiers of the proposed residential units and the occupiers of the existing HMO by reason of loss of privacy. As a result, the proposed development is contrary to Local Plan 2011-2032 Policy D2 which seeks to deliver buildings, places and spaces that respect the amenity value of the occupiers of nearby buildings and the wider area, Local Plan 2011-2032 Policy D25 which requires development to respect the residential amenity of neighbouring dwellings and the amenity of future occupants of new dwellings and the National Planning Policy Framework.

Existing plant associated with 27-28 Cornhill is sited to the rear elevation of the existing building in close proximity to the proposed development. The proposed development has failed to address the impact of this existing plant in relation to noise and odour impacts and in turn has failed to demonstrate that an acceptable standard of amenity can be achieved for future occupiers of the proposed development. As a result, the proposed development is contrary to Local Plan 2011-2032 Policy D2 which seeks to deliver buildings, places and spaces that respect the amenity value of the occupiers of nearby buildings and the wider area, Local Plan 2011-2032 Policy D25 which requires development to respect the residential amenity of neighbouring dwellings and the amenity of future occupants of new dwellings and the National Planning Policy Framework.

The proposed development has failed to demonstrate that adequate light levels can be achieved within Bedroom 1 and 2 of Plot 1 and in turn that an acceptable standard of amenity can be achieved for future occupiers of this proposed residential unit. As a result, the proposed development is contrary to Local Plan 2011-2032 Policy D2 which seeks to deliver buildings, places and spaces that respect the amenity value of the occupiers of nearby buildings and the wider area, Local Plan 2011-2032 Policy D25 which requires development to respect the residential amenity of neighbouring dwellings and the amenity of future occupants of new dwellings and the National Planning Policy Framework.

The proposed development has failed to demonstrate that it would maintain a sufficient level of sunlight to the existing solar panels on the adjacent building 7-8 York Buildings such that their ability to generate low carbon electricity would not be undermined. As a result, the proposed development is considered contrary to Local Plan 2011-2032 Policy S4 and D4 which seek to maximise energy from renewable resources and tackle climate change through the transition to low carbon energy.
