The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990 ( as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).

The development hereby permitted shall be carried out in accordance with the approved plans listed in schedule A. Reason: For the avoidance of doubt and in the interests of proper planning.

The development hereby approved shall be carried out in accordance with the details set out in "Keytech Development Design Ltd. Flood Resilience Report" dated July 2023. The scheme shall be fully implemented and subsequently maintained thereafter, in accordance with the approved scheme. Reason To reduce the residual risk of flooding to the proposed development and its future users in accordance with policy D1 of the Sedgemoor Local Plan 2011-2032.

Unless otherwise agreed in writing by the Local Planning Authority the construction and operation of the development shall be in accordance with the Local Labour Agreement between Adams Morey Limited and Sedgemoor District Council dated 25th August 2022. Reason: In accordance with the aims of policy D15 of the Sedgemoor Local Plan in order to optimise opportunities for local labour to be used in the project.

If, during the works contamination is encountered which has not previously been identified, then the contamination shall be fully assessed and an appropriate remediation scheme shall be submitted to and approved in writing by the local planning authority. Reason: To protect the health of future occupiers of the site from any possible effects of contaminated land.

No demolition/construction work (other than internal fitting out works) or deliveries to and from the site shall take place outside the hours of 07:00 to 18:00 Mondays to Fridays, 08:00 to 13:00 on Saturdays, with the exception of specific works which shall have been agreed in advance and in writing by the local planning authority and shall include details of the task, the date and duration of works. No works to take place on Sunday and Public Holidays. Reason: To protect the amenity of local residents from potential impacts whilst site clearance, groundworks and construction is underway in accordance with policies D24 and D25 of the Sedgemoor Local Plan.

Any external lighting must only directly illuminate the application site and shall be fully adjustable and shall be maintained as such thereafter. Reason: To avoid obtrusive light pollution and protect dark skies in accordance with policies D24 and D25 of the Sedgemoor Local Plan

Prior to the first use of the buildings hereby permitted, the waste storage details show on the submitted and hereby approved Site Plan Proposed Site Plan Drg No. 2022-2754-09B shall be installed. The facilities shall thereafter be retained and maintained for the lifetime of the development hereby approved. Reason: To protect the amenity of the locality, especially for people living and/or working nearby, in accordance with policies D24 and D25 of the Sedgemoor Local Plan.

Prior to the first use of the development hereby approved, the details set out in the submitted and hereby approved Drainage Plan Drg No. 2022-2754-18A and the Marsh Silt Trap Information shall be installed. Once installed such measures shall be retained and maintained thereafter in perpetuity. The applicant should install an oil separator where appropriate, to any surface water drainage system located within the application area. Reason: To prevent pollution of the water environment in accordance with policy D24 of the Local Plan

The rating level of any sound as part of this development (as defined within BS4142:2014 or subsequent amended versions), shall not exceed the prevailing background noise level at any time, when measured or calculated at the boundary of any noise sensitive dwelling. The assessment method used shall be in accordance with BS4142:2014 - 'Methods for rating and assessing industrial and commercial sound'. Reason: To safeguard local residents from noise and disturbance as in accordance with policy D25 of the Sedgemoor Local Plan 2011-2032.

The proposed shutter shall be fitted with brush seals at the head and sides and with a neoprene seal at the bottom, to prevent rattle caused by the wind and shall be retained thereafter in perpetuity. Reason: To safeguard local residents from noise and disturbance as in accordance with policy D25 of the Local Plan.

The development hereby approved shall not be occupied until measures for the enhancement and protection of biodiversity have been installed in accordance with details that have been submitted to and approved in writing by the Local Planning Authority. Once implemented such measures shall be retained at all times thereafter. Reason: To safeguard and promote biodiversity in accordance with policy D20 of the Sedgemoor Local Plan 2011-2032.
